THE ONE-WAY DOOR The tariff refund has a name on it, and the name is the importer’s Customs has certified about $122 billion. Meanwhile a fourth statute has taken over the tariffs themselves. |
There is a box near the top of a United States customs entry form. It is marked importer of record. |
Whoever is named in that box is the person the government refunds. |
On February 20 the Supreme Court ruled that the emergency powers act does not let a president impose tariffs. The case was Learning Resources against Trump. |
Customs stopped collecting those duties on goods entered after midnight on February 24. |
What had already been collected had to go back. A refund system opened on April 20. |
By mid September, Customs had certified about $122 billion, interest included, and sent it to the Treasury. |

All of it goes to importers of record, or to a party an importer names. |
The household that paid more for the imported thing is not in that queue. There is no form to join it. |
About 20,184 refunds worth $1.3 billion were still sitting on hold. The importers had not given Customs their bank details. |
A third phase opened on October 6 for entries already finalised. Only plaintiffs with a live case can use it. |
So the refund is real, it is enormous, and it is addressed to a list you are almost certainly not on. |
Now the other half of it. The tariffs did not leave. |
On the same day collection stopped, a new one went on under Section 122 of the Trade Act of 1974. |
Ten percent the first day. Fifteen the next. |
That one had a clock. One hundred and fifty days, lapsing on July 24. |
Underneath it, the authorities the Court did not touch kept running. Section 232 on steel and cars. Section 301 investigations. |
And then a statute almost nobody had reached for. Section 338 of the Tariff Act of 1930, in force from August 22. |
Fifty percent on certain Canadian goods, with carve outs. Section 232 goods are exempt, and some aircraft lines pay five. |
It reaches about $17.7 billion of Canadian imports. |
Global Trade Alert, which models this, put the trade weighted average United States tariff on Canada at 6.27 percent afterwards. Before it, 4.37. |
On October 23 the White House rewrote that list again. |
Valves, carpets and some waste products go on. Plywood, some paper, some machinery and refrigeration equipment and some packing crates come off. |
The change takes effect on October 30. |

THE MOVE · TWO VERSIONS, PICK YOURS If you import anything, even occasionally, check whose name sits in the importer of record box on your entries. Then check that Customs has your bank details. If you do not import, the step is smaller. Before a large purchase of something made abroad, ask the seller about the tariff line. A seller who cannot answer is telling you something too. Nobody can give you the tariff share of a shelf price with precision. Exemption lists are long and pass through varies by product. |
