An Air Taxi Entered Dallas Fort Worth Airspace On September Tenth
It flew under a class the FAA wrote from scratch, the first since the helicopter. The rulebook is finished. The aircraft is not certified.
The rule came first. On October 22, 2024 the FAA published an 880 page final rule creating powered-lift, a class that lifts like a helicopter and cruises like an airplane. It was the first new category of civil aircraft in nearly eighty years.
On September 10 a Joby S4 flew route segments into the controlled airspace at Dallas Fort Worth, a five day campaign under the federal pilot program. Six days earlier an Archer Midnight flew Salinas to Hollister in about twelve minutes.

YEARS SINCE THE FAA LAST CREATED A CLASS OF AIRCRAFT
A class written into federal regulation is not a forecast that gets walked back. Any one aircraft can fail. The class it belongs to exists either way.
That is the part that does not go back. The rule landed on a Tuesday in October and the coverage lasted about a day.
If you watched this industry for five years and filed it under renderings and press offices, that was fair. There was no rule to certify anything against.
There is one now, and the aircraft are flying inside real airspace on published dates. That is a different situation from the one you judged.

The pilot training provisions carry a ten year review. The class of aircraft does not expire with them.

Who is already repositioning?
Airports and state programs, not the stock market. Joby sits in the fifth and final stage of type certification, Archer has closed the third, and over twelve months their shares fell about 60 and 40 percent.

What does being late cost?
Nothing, until a type certificate is issued. That is the gate, and it has not been issued to anyone.

Watch for one document, not one more demonstration. The FAA type certificate.
Demonstration flights are scheduled by companies. Type certificates are issued by the agency, and they are public. The caveat that would prove this wrong: if the fifth stage turns up major airworthiness findings, the certificate slides past 2027 and waiting is the right call.
